Guideline for reporting trademark and copyright infringements with One Click Actions

One Click Actions is committed to the protection of intellectual property. If you are the owner of a trademark or copyright and suspect an infringement of your rights, this policy provides you with a structured framework for reporting such cases. This policy outlines the procedures for reporting suspected trademark or copyright infringement.
1. notification of a trademark infringement
If you are a “Complainant” and wish to report a trademark infringement of which you are the owner, please send an e-mail to abuse@oneclickactions.com with the subject “Trademark Infringement”. Please provide the following information to enable a quick processing:
- Trademark identification: Name the trademark or sign that has allegedly been infringed, including the registration number.
- Jurisdiction: Specify the geographical jurisdiction for which the trademark is registered.
- Information on the trademark owner: Name, postal address and telephone number of the trademark owner.
- Products/services: Describe the products or services offered under the trademark.
- First use: Date of first use of the trademark.
- Description of the alleged infringement: Explain how and where your trademark is infringed.
- Proof of connection to One Click Actions: Prove that the owner of the website allegedly infringing the rights is a customer of One Click Actions.
- Exact location of the violation: Enter the exact URL or other location information.
- Good faith statement: Confirm under penalty of perjury that you believe that the use of the content infringes the rights of the [Name der Marke] trademark and that the use of the infringing content is unlawful.
2. notification of copyright infringement
If you are a “Complainant” and wish to report a copyright infringement, please send an email to abuse@oneclickactions.com with the subject line “Copyright Infringement”. Please provide the following information to ensure effective processing:
- Description of the protected content: Describe the work whose copyright has allegedly been infringed.
- Exact location of the infringing content: Provide the URL or exact details of where the allegedly infringing content is located.
- Information on the copyright holder: Name, postal address and telephone number of the copyright holder.
- Good Faith Statement: Certify that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- Statement of accuracy: A statement that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
- Signature: A physical or electronic signature of the authorized person.
3. contraindication
If you are a “Respondent” and have received a notification of alleged trademark or copyright infringement and believe that the complaint is without merit or that you have the right to use the material, you may submit a counter-notification. Send this counter-notification by email to abuse@oneclickactions.com with the subject line “Counter-Notification” and the following information:
- Identification of the removed material: Describe the material that was removed and its exact position before removal.
- Good Faith Statement: Certify under penalty of perjury that you have a good faith belief that the material was removed due to mistake or misidentification.
- Contact Information: Provide your name, address and telephone number and agree to submit to the jurisdiction of the district court in which your address is located or, if your address is outside the United States, to the jurisdiction of a court in which One Click Actions is located.
- Signature: A physical or electronic signature of the person submitting the counter-notification.
One Click Actions undertakes to examine all incoming complaints and contraindications promptly and to take appropriate measures.
