Domain registration agreement from One Click Actions

This Domain Name Registration Agreement (“Agreement”) is a contract between One Click Actions (“Registrar”) and you (“Registrant”) and sets forth the terms and conditions for the registration, use and renewal of domain names through One Click Actions. By registering a domain name through our service, you agree to all of the terms and conditions set forth herein, as well as the Registry’s policies, ICANN regulations and German law.
1. definitions
- Registrar: One Click Actions, the organization authorized to manage and register domain names, which handles the interaction with the respective registries.
- Registrant: The natural or legal person who registers a domain name via One Click Actions and is responsible for its use.
- Registry: The entity that manages a particular top-level domain (TLD) and sets policies for its allocation and management.
- ICANN: Internet Corporation for Assigned Names and Numbers, which oversees the administration of domain names and IP addresses.
- Domain name: A unique identifier on the Internet that is registered under a specific top-level domain (e.g. .com, .net, .org) and is administered according to the policies of the registry and ICANN.
2 Scope of the agreement
This agreement applies to all domain registration requests managed by One Click Actions and covers the rights and obligations of the registrant and registrar in relation to domain name registration, renewal, transfer and termination.
3 Obligations of the registrant
- Provision of accurate information: The registrant must provide complete, truthful and current information at the time of registration and update it throughout the validity period of the domain. This includes full name, postal address, e-mail address, telephone number and other required contact details.
- Compliance with regulations: The Registrant warrants that the use of the registered domain name complies with all applicable laws and regulations, including German and international regulations.
- Permitted use of the domain: Registrant agrees not to use the domain for illegal activities such as intellectual property infringement, fraud, malware distribution, spam, phishing or other prohibited uses in accordance with ICANN policies and Registry policies.
- Responsibility for the domain: The registrant is responsible for all activities conducted with their domain and agrees to indemnify One Click Actions for any damages or losses resulting from misuse of the domain.
4. rights and obligations of One Click Actions as registrar
- Registration processing: One Click Actions handles the processing of your registration request in cooperation with the relevant registry and ensures that your domain is properly registered in the domain name system.
- Protection of personal data: One Click Actions processes and protects the registrant’s personal data in accordance with its privacy policy and in compliance with applicable data protection laws such as the GDPR.
- Domain Suspension or Cancellation: One Click Actions reserves the right to suspend, cancel or transfer the registration of a domain if it is determined that the Registrant has violated this Agreement, the Registry Policies, ICANN rules or applicable law.
- Notification of Changes: One Click Actions will notify the Registrant of any changes to the policies of this Agreement or the Registry Policies using the contact information provided by the Registrant.
5. registration period and domain renewal
- Registration period: The domain is registered for the period selected by the registrant during registration. At the end of this period, the domain must be renewed in order to retain its validity.
- Automatic renewal: Unless otherwise stated, One Click Actions offers the option to automatically renew the domain at the end of the registration period. The registrant is responsible for ensuring that the payment information is current and sufficient to cover the auto-renewal.
- Renewal reminder: One Click Actions will send reminders to the registrant prior to the domain expiration date using the contact information provided.
- Cancellation in case of non-renewal: If the domain is not renewed before the expiration date, One Click Actions may cancel the registration and make the domain available to other users.
6. transfer of domain names
- Transfer to another registrar: The registrant may transfer their domain to another authorized registrar in accordance with the Registry Policy and ICANN rules. The registrant must request the transfer from One Click Actions and fulfill all transfer requirements, including the corresponding payments.
- Internal transfer: If the registrant wishes to transfer the domain to another user within One Click Actions, they must follow the procedures and pay the specified fees.
- Transfer Restrictions: The Registrant accepts that there may be a 60-day lock period after the initial registration or transfer during which the Registrant cannot transfer the domain to another registrar.
7. guidelines for dispute resolution
- Compliance with the UDRP: Disputes relating to the ownership or use of a domain name are resolved in accordance with ICANN’s Uniform Domain Name Dispute Resolution Policy (UDRP).
- Additional dispute resolution procedures: In some cases, additional, registry-specific dispute resolution procedures may be applicable. One Click Actions will inform the registrant if such procedures are available.
8. fees and payments
- Payment of Fees: Registrant agrees to pay all applicable fees for registration, renewal, transfer and other additional services provided by One Click Actions.
- Refunds: Unless otherwise stated, fees paid are non-refundable, including those related to canceled registrations, failed transfers or unused registration periods.
- Taxes and Additional Fees: Registrant is responsible for any applicable taxes or additional fees for domain registration services as required by applicable law.
9. limitation of liability
- Exclusion of liability: One Click Actions shall not be liable for any direct, indirect, incidental or consequential damages arising out of the use or inability to use the registered domain, including, but not limited to, lost profits, business interruption or loss of data.
- Force Majeure: One Click Actions shall not be liable for any failure to perform its obligations under this Agreement if such failure is due to events beyond its reasonable control, including but not limited to natural disasters, war, acts of government or network failures.
10. amendments to the agreement
- Right to amend: One Click Actions reserves the right to amend this agreement at any time. Amendments will take effect as soon as they have been published on the One Click Actions website.
- Notification to the Registrant: One Click Actions will notify the Registrant of any changes to this Agreement using the contact information provided. Continued use of the domain after the changes will be deemed acceptance of the changes.
11 Applicable law and place of jurisdiction
- Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Germany.
- Place of jurisdiction: All disputes arising in connection with this agreement shall be subject to the exclusive jurisdiction of the courts in Frankfurt am Main, Germany.
By registering a domain name through One Click Actions, you agree to all of the terms and conditions set forth in this Agreement and agree to abide by the policies set forth by the Registry and ICANN.
